These terms and conditions (hereinafter referred to as the “Terms and Conditions”) are intended to regulate access to and acquisition of the products and services of eGoGames (the “eGoGames Services”) provided through the websites www.egogames.com and www.egogames.es, indistinctly (hereinafter referred to as the “Website”), which will be made available to the User through a video game eSports platform developed by eGoGames (as defined below) of which eGoGames is the owner (hereinafter referred to as the “Platform”).
Once this document is subscribed, these Terms and Conditions will be binding for the parties and will govern the provision of services requested by the User at all times.
By registering and clicking on “I accept,” the User:
Accepts and declares to have read, understood, and consented to these Terms and Conditions and our Privacy Policy and Cookie Policy, as well as the obligations and rules governing the video games and competitions organized by eGoGames, in order to use the User’s account on the Platform (as defined below) and participate in the video games and competitions.
Egogames 2023, S.L. (hereinafter “eGoGames”) is a limited liability company established under Spanish legislation, with CIF B87823753 and registered office at Calle José Ortega y Gasset, No. 8, 4th Left (28006) Madrid, and registered in the Madrid Commercial Registry, Volume 36,036, Page 130, Sheet M-6477550.
The User must register in accordance with Section 3 of these Terms and Conditions. In this regard, when the User participates in video games for real money and decides to withdraw their funds, they must complete a form with their specific personal data, being the User solely responsible for the truthfulness and authenticity of the same.
eGoGames makes these Terms and Conditions available to the User in order to define access to and use of the Platform and the eGoGames Services, as well as to clearly and precisely articulate the relationships between eGoGames and the User.
In this regard, eGoGames aims to provide the User with a platform where they can compete in various skill-based video games from their mobile device, allowing them to participate in competitions with the option to win real money prizes through different forms of competition.
To participate in video games on the Platform, the User must have previously accepted these Terms and Conditions before starting any video game, having expressly accepted the Privacy Policy and the Cookies Policy as well.
Additionally, the User must, prior to starting their participation in any video game, successfully complete the user registration process established on the Platform (understood as the unique registration that allows the user to access, as a participant, the eGoGames Services offered through the Platform), in accordance with the following specialties:
In case of loss or forgetting the username and/or password, the User can request a password change through the Platform. Once this option is requested, the User will receive an email at the address provided to proceed with the password change. If the User has not provided an email address in accordance with the details in the previous section, they must contact eGoGames Customer Support for recovery of their username and/or password.
The chosen username can be changed, free of charge, once. In the case of second or subsequent modifications, it can be redeemed in the store section.
If the chosen username contains offensive language or is offensive, eGoGames will contact the user through the associated email address requesting an immediate modification of the username; if after 24 hours the user has not made any changes, the account will be deactivated.
The User is responsible for maintaining the confidentiality of their username and password, as well as all transactions and movements of their User Account.
The User agrees not to share any of their identification elements with others and to take all necessary measures to keep them secret. The User is the sole and exclusive responsible for the custody of their password and its personal and non-transferable use, being accountable for its use, authorized or not, by third parties, and exonerating eGoGames from any liability that may arise from any use made in the name of the User.
Only one active user registration is allowed. The User cannot have more than one active User Account on the Platform. Before registering another distinct User Account, the User must deactivate the previous one.
The User Account is personal and non-transferable, and reflects the economic transactions linked to participation and use of the eGoGames Services offered by the Platform and any other additional service offered by eGoGames. eGoGames reserves the right to deactivate all accounts associated with the same user (multiple accounts with the same IP address may be considered as the same user, among other considerations that will be taken into account). The transfer of funds between multiple accounts using the social function of the platform will result in the automatic closure of all associated accounts.
If the User suspects that their User Account may be compromised, they must contact eGoGames to proceed with its blocking and, if applicable, to change the password. In any case, for security reasons, it is recommended to change the password regularly.
eGoGames reserves the right to prevent the opening of a User Account when the holder of the same is not the User themselves, or to suspend the User Account (in the event that it has been opened) and retain any balance that may exist in it.
If there are indications that the User Account is being used by someone other than the person registered, or that it is being used fraudulently, eGoGames may cancel the User Account if there are sufficient indications of fraudulent or illegal use of it.
eGoGames is not responsible for third-party access to the User Account and under no circumstances will it assume responsibility for any loss, costs, claims, expenses, or damages that the User may incur as a result of unauthorized use of the User Account by any other person, or as a result of unauthorized access to the User Account. In this sense, all transactions where the username and password are correctly provided will be considered valid, whether or not they have been authorized by the User.
The User may request the temporary or permanent closure of their User Account. The period of voluntary closure will be determined by the User, notifying eGoGames Customer Support.
If the User requests the permanent closure of the User Account, it cannot be reopened.
Access to the Platform is prohibited to anyone under 14 years of age. Therefore, by accepting these Terms and Conditions, the User declares and acknowledges that they are over 14 years old and that, if the User is between 14 and 18 years old, their legal guardian has reviewed these Terms and Conditions and has given their consent to them and to the User's use of the Platform.
Notwithstanding the provisions of clause 3.1.1 above, eGoGames reserves the right to request documentary proof of your identity and age by the means it deems appropriate. In this sense, if eGoGames requests the aforementioned documentary proof from the User and they do not comply with the submission of the required documentation within one (1) month, eGoGames will proceed with the cancellation of the user registration and User Account. Consequently, (i). (a) if the balances of the User Account exceed the deposited amounts, eGoGames will proceed to refund only the latter; (b) if the balance of the User Account is less than the deposited amounts, eGoGames will proceed to refund the amount of the balance that is credited to the User Account; and (ii) if the documents are inaccurate or have been altered or manipulated, eGoGames will have no obligation to accept such documents as valid.
(a) if the balances of the User Account exceed the deposited amounts, eGoGames will proceed to refund only the latter;
(b) if the balance of the User Account is less than the deposited amounts, eGoGames will proceed to refund the amount of the balance that is credited to the User Account; and
In the event provided in point (II) above, eGoGames reserves the right to suspend the User Account, prohibit them from participating in the Platform's video games, and retain all their funds when there are indications of forgery and submission of forged, stolen, or inappropriate documents.
eGoGames reserves the right, with or without prior notice, to modify, suspend, or terminate the User's access to the Platform for the following reasons:
In the event that eGoGames has indications that the User has engaged in collusive or fraudulent behavior while using the Services offered by eGoGames through the Platform, it may temporarily suspend the User until the incident is clarified.
If eGoGames has sufficient evidence to consider proven that the User has committed fraud, collusion, made their User Account available to third parties, or has breached the Terms and Conditions in any way, eGoGames may notify the User to present any arguments they deem appropriate, and after analysis, eGoGames may unilaterally resolve these Terms and Conditions. In this case, eGoGames reserves the right to close the User Account and to retain all funds deposited in the User Account.
The User may need to download some type of software in order to use the Platform (the “Software”). In such cases, the offered Software will include a license authorizing its use by the User (or a sub-license to the extent that the Software is owned by a third party). The terms under which the User may download and use such Software will be available at the time of download and must be accepted by the User before using the Software.
For any service identified by eGoGames as a “beta” version (“Beta Service”), the User acknowledges and agrees that the Beta Services may contain more or fewer features than the final version of the service. eGoGames reserves the right, at its discretion, not to release a final version of a Beta Service or to alter its characteristics, specifications, capabilities, functions, license conditions, release dates, general availability, or other features.
Beta Services may contain errors that affect proper operation and functionality.
Games for each video game may be paused for one (1) hour, with the game being forcibly and automatically paused if the User exits the application voluntarily or involuntarily (due to, among other causes, technical failures, loss of coverage, battery depletion, etc.).
In case of loss of Internet connection for any reason (loss of coverage, battery depletion, etc.), the game result cannot be sent to the server. In this case, the final result of the User's game will be the last score sent to the server prior to the disconnection.
If the User has not finished the game or has not been able to submit the score to the Services and/or eGoGames server, the result will correspond to the last score received by the server (with the result being equivalent to zero (0) if the User has not been able to submit any score to the Services and/or eGoGames server), with the winner being the User whose score recorded on the server, according to what is mentioned in this clause, is higher.
If the User, having advanced to the next round (or having tied for the first time in the same) in a bracket tournament, does not complete the next game within the stipulated time, they will lose the right to a prize or refund in that tournament.
Notwithstanding the provisions of this Clause, eGoGames will not be responsible under any circumstances for any disconnections or exits from the application by the User due to reasons attributable to them, which the User acknowledges and accepts may cause the inability for the game result to be sent to the server, thus making the result equivalent to zero (0).
If a competition is not completed due to the minimum entries required/equivalent to the prize awarded, the tournament may be canceled, returning the full entry fees to all participants in the competition.
Finally, if the User plays a game and does not find an opponent within the next 48 hours, meaning the game remains unpaired, the game will be considered finished. The User will receive a refund of the amount paid to enter the competition.
In addition to what is provided in Section 9 below, eGoGames states that it may include links to third-party services and websites on the Platform.
The User accepts that they do not have control over the content and services of such third parties, which may have their own terms and conditions and which are not endorsed by eGoGames, and therefore eGoGames will not be liable to the User for any losses or damages caused by such third parties.
Any damage or expense caused to the User in relation to such third parties will be the responsibility of the User.
In this regard, the User declares, acknowledges, and guarantees that they are aware that when providing data to third parties, they provide it according to the privacy policy (if any) of those third parties, and that eGoGames' Privacy Policy does not apply in relation to those data.
eGoGames does not assume any responsibility for warranties, express or implied, related to the Platform, which is provided to the User “as is,” and is offered without warranty and without any responsibility regarding its quality, suitability for use, completeness, or accuracy.
Although eGoGames will make its best efforts to provide you with a service of the highest quality, reliability, and security, eGoGames does not guarantee that the eGoGames Services (Website, Platform, Software, services, video games, etc.) will operate uninterrupted, timely, or free of errors.
Additionally, eGoGames does not guarantee that the Platform is free from viruses, failures, or other defects, and will make its best efforts to take all reasonable measures to ensure the continuity of eGoGames service.
Access to the Website and/or the Platform may be temporarily limited when maintenance, updates, or similar work is required.
The User agrees not to upload, communicate, transmit, or otherwise make available content in the available chats or anywhere else on the Platform:
That is or may reasonably be considered illegal, harmful, harassing, defamatory, slanderous, obscene, or objectionable in any other sense;
That is or may reasonably be considered a violation of the privacy of other individuals;
That is or may reasonably be considered inciting violence or racial or ethnic hatred;
That the User does not have the legal right to make available (such as privileged information, property of others, or confidential information);
That infringes any intellectual property rights or any other proprietary rights of third parties;
That contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of the Platform or any computer software or hardware or telecommunications equipment, or that consists of unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of advertising messages.
Furthermore, the User declares, guarantees, and agrees that:
Accordingly, if eGoGames suspects that a User is, or has been, part of fraudulent or illegal activity or detects suspicious behavior regarding money laundering activities, or if the User acts in a manner that breaches these Terms and Conditions, their access to eGoGames Services may be immediately canceled and/or their User Account blocked, in accordance with the provisions of these Terms and Conditions (without prejudice to any internal investigation actions that eGoGames may carry out, or the exercise of legal actions that the parties may be entitled to).
Illustratively, and without being exhaustive, the following is prohibited:
eGoGames will communicate with special attention any complex, unusual, or purposeless economic operation or behavior pattern, or that shows signs of simulation or fraud, and, if applicable, will communicate the signs and/or collected evidence to the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offenses.
Opening an account or participating in games without real money is completely free. For participating in video games and competitions offered on the Platform where participation is done with real money, within the 1vs1 mode, costs arise for which eGoGames will charge a commission on the total amount of the game. This amount will not be eGoGames' absolute profit, but will be allocated for the different tournaments, leagues, and events held on the platform.
eGoGames is fully committed to the security of User funds, maintaining them in segregated accounts, which will under no circumstances be used for operational purposes. This ensures that Users' funds are always available for withdrawal according to the banking and security procedures established by eGoGames.
Transfers of funds between User Accounts associated with different user registrations, that is, associated with different individuals, are not allowed.
By providing eGoGames with payment methods, the User:
In case eGoGames makes any billing error to the User, they must report it within one hundred twenty (120) days after the first appearance of the error on their invoice. If the User does not inform within this period, eGoGames will not be responsible for any losses caused by this error.
The User may not, under any circumstances, use a payment method owned by a third party.
Invoices issued by eGoGames will include the corresponding taxes.
The payment of prizes will be made through an accounting entry at the moment the video game is completed.
The winner is determined based on the score obtained at the end of the game. All players of the same game and the same match have the same seed, so the one with the highest score will win.
If a prize is awarded to a User and they are eligible to receive it according to these Terms and Conditions, eGoGames may require any documentary evidence or proof of any kind demonstrating that participation was carried out in accordance with the Terms and Conditions if any signs to the contrary are detected.
If the User fails to submit the requested documentation within one (1) month, no payment will be made for any prizes that may have been generated during that period, and payment may be canceled and deducted from the User Account if it has been credited.
In cases where non-monetary or in-kind prizes are awarded to the User, their value will include the indirect taxes borne by eGoGames in their acquisition.
The prize for leagues will be awarded in withdrawable real money.
You may be granted bonus cash. Bonus cash can be used to participate in money games, but it cannot be withdrawn or used for any other service. When you participate in a money game, 10% of the entry fee will be used in bonus cash. Additionally, additional bonus cash will be used to participate in money games if bonus cash is the only currency available in your account.
When you win a money game, the portion of bonus cash you used to pay the entry fee will be returned to you, and any additional winnings beyond your entry fee will be paid in real money. If you initiate a withdrawal of funds from your account, you will lose all bonus cash that is in your account at that moment. If you do not participate in a money game for a continuous period of 60 days, you will lose all bonus cash in your account.
When the User requests a withdrawal of funds or when they request an in-kind prize (from the in-kind prizes included in the gifts section on the Platform), eGoGames will require the User to complete a form with information and documentation regarding their identity and place of residence, as well as the necessary information to proceed with the fund transfer (Full name, Phone number, Address, Postal code, Nationality, Province, City, and a copy of their National Identity Document).
In addition to the above, eGoGames reserves the right to request additional information deemed necessary to verify the correct destination of the withdrawn amounts at any other time or in subsequent withdrawal requests for funds or in-kind prizes, as well as to request information from any person outside the User. This documentation and information will allow eGoGames to verify that the data provided during registration matches the data in that documentation.
Unless there is a breach and/or cancellation, eGoGames will not proceed with the transfer of the requested funds or the accreditation of the requested in-kind prize until the requested documentation and information has been verified or if such information is not provided or is incorrect.
The User may request the total or partial withdrawal of funds from their User Account after making a minimum deposit of €30 and having played at least 40 games for real money, requiring eGoGames to transfer those funds or credit the prize. Withdrawal requests for amounts less than €20 cannot be made. The withdrawal of funds may take up to ninety (90) days to be processed.
Amounts greater than the balance of the User Account cannot be withdrawn.
If eGoGames detects any act of bad faith or cheating in a game by the user, it has the option to block that account and its funds.
On the other hand, digital goods (as defined in Section 7) and bonus funds (as defined in Section 6.5) cannot be withdrawn.
It is the User's responsibility to immediately notify eGoGames, through its Customer Service, of any funds that have been transferred to their User Account by mistake. In the event of such a situation, the User agrees not to dispose of such funds under any circumstances, reserving eGoGames the right to block the User Account until the situation is normalized, withdraw such funds, and cancel any transactions made with them.
eGoGames will pay on behalf of the winning User the amount corresponding to the withholding or advance payment of the Personal Income Tax (I.R.P.F.) or, if applicable, the Non-Residents Income Tax (I.R.N.R.), that is in force at the time of payment. These amounts will be deducted from the prize to be received by the User.
eGoGames may conduct promotional campaigns offering bonuses or other promotional offers. The conditions of these campaigns will be clear and accessible from the User Account. Each specific promotional campaign must be expressly accepted by the User. If the conditions specify an amount to accumulate, for example, points, the User can check the points they have accumulated or the points they have left to meet the conditions. Bonuses will be granted to be played, and under no circumstances can they be cashed. This bonus can be converted into real money by entering a real money game and winning it. Bonuses will be valid for a period of thirty (30) days.
Moreover, in the event that a User makes use contrary to the Terms and Conditions, or fraudulent use of a promotional activity, eGoGames may deny, withhold, or withdraw any bonus or promotion from that User, or rescind any policy regarding it, whether temporarily or permanently, and terminate the User's access to the services and/or block the User Account and, if applicable, cancel it.
Each User will only have the right to release a specific bonus, and the same bonus cannot be assigned to the same person more than once.
eGoGames may terminate these Terms and Conditions and close the User Account and their user registration (username and password) immediately and without prior notice when any of the following situations occur:
Unless otherwise stipulated in the Terms and Conditions, upon termination of the Terms and Conditions, any balance in the User Account will be refunded, in accordance with the provisions of these Terms and Conditions, as well as, in particular, Section 6.4.2, within a maximum period of ninety (90) business days from the termination or from the moment the identity and other details of the User are verified, in addition to eGoGames' right to withhold any amounts owed by the User for the reasons established in these Terms and Conditions.
If the user account remains inactive for a period of 30 days, eGoGames reserves the right to cancel any balance classified as Bonus Cash, which is considered as non-withdrawable bonus money on the platform.
If the User Account is inactive for at least six (6) months, eGoGames reserves the right to cancel any balance classified as real money.
By using a credit card to make deposits or withdrawals of funds in a User Account, the User guarantees that they are the cardholder or are authorized to use that credit card.
The User agrees to promptly notify eGoGames of any changes to the credit card account number, expiration date, and/or if the credit card expires or is canceled for any reason.
eGoGames assumes no liability for any loss caused by the unauthorized use of the credit card or other payment method by a third party in relation to the services of the Platform. Any attempt to defraud through the use of credit cards or other means of payment, regardless of the outcome, will result in the immediate termination of their User Account and the loss of earnings, in accordance with the provisions of these Terms and Conditions.
The Software of the Platform and its contents are protected in accordance with national and international intellectual and industrial property regulations (software, illustrations, music, trademarks, etc.), which are owned by eGoGames or third parties who have consented to their use.
Any infringement of these rights, including reproduction, distribution, public communication, transformation, or any other unauthorized use of the elements protected by intellectual and industrial property, will be pursued by eGoGames, as appropriate, before the civil or criminal jurisdiction.
As long as the User complies with these Terms and Conditions, eGoGames grants the User a non-exclusive, non-transferable, personal, revocable, and limited license for access to and use of the Platform (but not the objects or source code related), provided that such use is made for the purposes set forth in these Terms and Conditions. In this regard, the User agrees not to use the Platform or any of its elements for anything else.
By submitting content through the Platform, the User guarantees that:
The Platform may allow the creation of digital objects, such as avatars. Such digital objects, in addition to the digital or virtual objects or assets assigned to your account, such as virtual trophies "Trophies" or other virtual goods, are collectively known as "digital goods." In this sense, the User irrevocably assigns and, subsidiarily, in case there is any legal impediment, licenses to eGoGames all exploitation rights over the digital goods, including, without limitation, all copyright rights, patent rights, trade secrets, trademarks, and other applicable intellectual and industrial property rights worldwide.
Furthermore, eGoGames reserves the rights related to the audiovisual and broadcasting exploitation of the competitions, events, and/or leagues organized, both in person and through the Platform.
In addition to what is provided in Section 9 below, the User agrees to indemnify, defend, and hold harmless eGoGames, as well as its group companies, shareholders, directors, and employees, from and against any claims, demands, obligations, damages, losses, costs, and expenses, including legal fees and any other charges, regardless of their origin, that may arise as a consequence of:
Except in those cases provided for in these Terms and Conditions, to the maximum extent permitted by law, under no circumstances shall eGoGames or any of its group companies or licensors (including any third-party provider) be liable for any special, incidental, direct, indirect, or consequential damages (including, but not limited to, damages for loss of business profits, business interruption, loss of business information, or any other economic loss) arising from the use (or misuse) of the Platform, even if eGoGames had prior knowledge of the potential occurrence of such damages.
eGoGames reserves the right to interrupt access to the Website and/or the Platform, as well as the provision of any or all of its eGoGames Services at any time and without prior notice, whether for technical, security, control, maintenance reasons, due to power supply failures, or for any other justified cause, without the User being able to claim reimbursement from eGoGames for the amounts of video game entries that had previously been correctly formalized.
In the event of interruption of eGoGames Services due to the malfunction of its systems, eGoGames will refund the User in their User Account solely the amount of their entry in the video games whose development is affected by such interruption, prior accreditation by the User of the entry amount made in case this information is not available or accessible to eGoGames for technical reasons or any other kind.
eGoGames is not responsible for any damage or harm to the User's Software or hardware that arises from accessing the Website and/or the Platform or from the use of eGoGames Services or the Platform, unless such damages were caused by issues directly attributable and enforceable to eGoGames.
eGoGames does not guarantee the suitability, reliability, availability, timeliness, or accuracy of information or eGoGames Services contained on the Website or the Platform, nor shall it be liable for direct or indirect damages related to the use of eGoGames Services from its Website or Platform, without any responsibility being demanded for the discontinuity or lack of availability of its eGoGames Services.
eGoGames shall also not be responsible in the event of gaming service interruptions, delays, errors, malfunctions, and, in general, any inconveniences arising from causes beyond eGoGames' control and/or due to a malicious or negligent act of the Users and/or arising from force majeure causes or causes external to eGoGames.
eGoGames does not guarantee that the content of its Website or Platform is suitable or available outside of Spain. In this regard, and according to the provisions throughout this Clause, in the event that all or part of the content of the Website is deemed illegal in countries or territories other than Spain, access to and/or use of the same by the User is prohibited, reserving eGoGames the right not to allow the User access to the Services through any of the modalities included in Clause 3.1.1 above that are participated in with real money. In the event that such access and/or use of the Website and/or Platform occurs, it will be solely at the User's risk, who is obliged to comply with the applicable national laws.
The offering of services provided by eGoGames through its Website or Platform is not directed to countries where such services are prohibited, additional requirements are imposed, or advertising thereof is restricted. In this regard, access to and/or use by foreign users of the Platform and/or Services offered by eGoGames may be limited in the event that restrictions on gaming by foreigners are established by the Government of the corresponding country that prevent or hinder access of foreign participants to the Services.
In relation to the above, the offering of services provided by eGoGames through its Website or Platform may be limited in the event of access and/or use by users located in territories such as (by way of example but not limited to): Afghanistan, Belarus, Bulgaria, Democratic Republic of the Congo, Ivory Coast, China, Cuba, Egypt, France, French Guiana, French Polynesia, French Southern Territories, Greece, Indonesia, Iran, Iraq, Italy, Japan, Lithuania, Macedonia, Malaysia, Myanmar, Nigeria, North Korea, Pakistan, Romania, Russian Federation, Sudan, Syrian Arab Republic, Turkey, Ukraine, Vietnam, Zimbabwe.
The use of the services offered by eGoGames, the information and content appearing on the Website and/or the Platform, and/or access to other third-party websites through links or connections that may appear on the Website and/or the Platform will be done under the exclusive responsibility of those who perform such acts, and eGoGames shall not be liable in any case for damages or harm that may arise from such uses or activities, nor for those that may be due to a lack of truthfulness, accuracy, completeness, and/or timeliness of the contents transmitted, disseminated, stored, made available, or received, obtained, or accessed through the Website or the Platform, nor for the content provided or offered by third parties or entities.
eGoGames will strive, to the extent possible, to update and rectify any information hosted on the Website and/or the Platform that does not meet minimum guarantees of truthfulness. However, eGoGames shall be exempt from all responsibility derived from its non-update or rectification, as well as from the content and information disseminated therein.
eGoGames is not responsible for security errors that may occur from using outdated browser versions, or for the consequences that may arise from the malfunction of the browser, whether due to improper configuration, presence of computer viruses, or any other cause external to eGoGames.
In case of errors in the communication system, bugs, or viruses related to account installation or other elements of eGoGames Services that result in loss of information for the User or any other damage to their equipment or Software, eGoGames will not be responsible in any way and reserves the right to cancel all affected services and take any action to correct such errors. In this regard, eGoGames is not obliged to provide any replacement for the network and/or systems or similar services.
eGoGames shall not be liable for any action or omission by its internet provider, or third parties, to whom the User has contracted services to access the server hosting the Website or the Platform.

eGoGames reserves the right to modify, update, and change the Terms and Conditions, as well as the Privacy Policy, the Cookie Policy, and the rules that apply to each of the video games offered on the Platform, in which case it will inform the user of such modifications or changes by publishing a new version of these Terms and Conditions on the Website and/or the Platform.
Notwithstanding the above, and in accordance with applicable regulations, express consent will be requested from the User by notification upon logging into their User Account for acceptance of the new version of the Terms and Conditions, with the User needing to expressly accept the new version of the Terms and Conditions. If the User does not agree, they will not be able to continue participating in eGoGames Services and must immediately request the blocking of their account. In such case, and as long as no breach of the Terms and Conditions has occurred on the part of the User, any balances the User had available in their User Account at the time of closure or blocking will be refunded to them.
The resolution of incidents, complaints, and claims regarding eGoGames Services will be carried out in accordance with the provisions set forth in the Help section included in the Platform and/or on the Website.
The User may make any claim at any time. To do so, they may write an email to the address support@egogames.com.
The User may submit their claim within a period of three (3) months following the date of the circumstance that gave rise to the claim. The claim will be addressed by eGoGames obligatorily, within a maximum period of one (1) month once the claim is received. The User must indicate in their correspondence their Username and a brief description of the events subject to the claim and their requests.
eGoGames will not tolerate any threatening, harmful, abusive, or violent behavior by the User towards any of its employees. In the event that the User behaves in such a manner (the determination of which will be at our sole discretion), eGoGames reserves the right to suspend and/or close their User Account and/or take any measures it deems appropriate.
By using our platform, the User accepts and acknowledges that any content generated, including but not limited to images, photographs, videos, and any other visual or multimedia material (hereinafter, "User Content"), may be used by eGoGames for promotional and advertising purposes, both online and offline.
Hereby, the User grants eGoGames a worldwide, non-exclusive, transferable, sublicensable, and royalty-free license to use, reproduce, distribute, modify, adapt, publish, translate, create derivative works, and publicly display their User Content in connection with the promotion and advertising of eGoGames, its products and services, and any other commercial or non-commercial purpose related to the platform and its activities.
The User declares and guarantees that they own all necessary rights over their User Content and that they have authorization to grant the aforementioned license to eGoGames. Furthermore, the User waives any moral rights they may have over their User Content to the extent permitted by applicable law.
eGoGames may record the matches played through the platform at our discretion and use such recordings for our commercial purposes in accordance with applicable laws and regulations. Among other things, we may broadcast, display, and share live or recorded games and tournaments from around the world. We may do this through any commercial channel or otherwise, such as (without limitation) Facebook Live, YouTube, Twitch, Kick, etc.
On the other hand, eGoGames is committed to respecting your privacy and using your User Content in accordance with our Privacy Policy.
The User may not transfer, assign, sublicense, or deliver in any way the rights or obligations that correspond to them under these Terms and Conditions.
Any dispute arising from or related to the legal relationship between the User and eGoGames will be resolved in accordance with Spanish law.
The services and content (TERMS AND CONDITIONS, PRIVACY POLICY, COOKIE POLICY, AND OTHER LEGAL DOCUMENTS) offered on the Website and/or on the Platform may be presented in different languages and dialects. In the event of a contradiction between the terms of use and other legal texts written in other languages, the Spanish version will prevail.
